In vitro diagnostics (IVDs) are tests done on samples such as blood or tissue that have been taken from the human body. In vitro diagnostics can detect diseases or other conditions, and can be used to monitor a person’s overall health to help cure, treat, or prevent diseases. Requirement

Provisional Patent Filing

If the decision was made to file a provisional patent application during the intellectual property assessment, the filing should be made at this stage if it has not been done already.
It is important to file as early as possible. Current intellectual property law is based on a first to file basis.
You should start by picking lawyers or patent agents who have some background in the technology. There are many patent attorneys but it is important to pick someone with a scientific background and some previous experience in biotechnology or medical devices. It may be more expensive but can make the difference between a successful IP strategy or an unsuccessful one. The filing itself is done by an intellectual property attorney or a patent agent. On meeting with the attorney or agent, they will assign what work the inventors need to do - to save costs try writing the first draft of the specification.
